Installing Active Sound Systems alters the noise emissions of the vehicle and is therefore not approved under the Road Traffic Act (StVZO)!
The buyer is responsible for regularly checking the installation of the actuators for stability.
Media-CarTec GmbH accepts no liability for loose parts and their consequences.
If the vehicle experiences electronic faults, this must be reported immediately to the Media-CarTec GmbH support team.
Media-CarTec GmbH reserves the right to limit and assume external costs incurred for fault diagnosis, up to a maximum of one hour.

Legal Provisions for Operation Outside Germany: In this case, the legal provisions of the respective country must be checked before operation.

Terms and Conditions of Media-CarTec GmbH

The European Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes related to their online orders without involving a court. In this context, we are legally obliged to draw your attention to our email address support@maxhaust.de.

Furthermore, we are neither willing nor obliged to participate in dispute resolution proceedings.

 

1. Scope of Application

1.1. Our deliveries, services, and offers are made exclusively in accordance with the following General Terms and Conditions. 

1.3. General terms and conditions of a supplier or customer do not become part of the contract, even if we do not expressly object to their applicability. Even if we refer to a letter that contains or refers to a supplier's or customer's terms and conditions, this does not constitute acceptance of such terms and conditions. 

 

2. Offer and Conclusion of Contract

2.1. By placing an order, the customer submits a purchase offer that is binding for four weeks from the date of receipt of the order by us. The purchase contract for the ordered goods is concluded with our written acceptance of the offer. Delivery of the ordered goods within the four-week period also constitutes acceptance of the contract offer. It is sufficient for the acceptance to send the acceptance or the ordered goods to the customer within the one-month period. 

 

3. Prices and Payment 

3.1. Our prices include VAT as required by law. They apply to the scope of performance and delivery specified in the order confirmation. Additional or special services are billed separately. 

3.2. Our prices are ex-works Mainhausen. Shipping costs are billed separately to the customer. 

3.3. Payment is made without deductions in advance by bank transfer to the account specified by Media-CarTec GmbH or by PayPal.

3.4. When using installment payment via easyCredit, the General Terms and Conditions apply additionally. You can find the terms and conditions here. Furthermore, when concluding a contract with easyCredit installment payment, the billing address must match the delivery address. Different delivery addresses are excluded.

3.5. When using installment payment via Klarna AB, the General Terms and Conditions of Klarna AB apply additionally: In cooperation with Klarna AB, Sveavägen 46, Stockholm, Sweden, we offer you the option of payment by invoice and installment payment. 4. Delivery, Shipping Costs, and Delivery Time

5. Warranty

5.1 Our warranty for defects in the ordered goods is 24 months from the transfer of risk. 

5.2 In the case of defects, we provide warranty by either rectification or replacement, at the customer's choice. If the defect is not rectified within a reasonable period or if rectification fails conclusively, the customer may demand a reduction in the purchase price (reduction) or withdraw from the contract, at their choice. 

 

6. Retention of Title

Until the purchase price has been paid in full, the delivered goods remain our property. 

 

7. Final Provisions/Consumer Information

7. 1. The language available for concluding contracts through the Media-CarTec GmbH website is exclusively German.

7. 2. You can find the essential characteristics, properties, and other features of the offered products and services in the individual product descriptions on the Media-CarTec GmbH website.

7. 3. The presentation of products and services of Media-CarTec GmbH on the Media-CarTec GmbH website is solely for informational purposes and does not constitute a binding offer for the services of Media-CarTec GmbH. Contracts for the delivery of goods between you and Media-CarTec GmbH are only concluded through email orders placed by you through the input forms provided on the Media-CarTec GmbH website, followed by a confirmation of acceptance by Media-CarTec GmbH. Acceptance is confirmed by email sent by Media-CarTec GmbH to the address provided by you during registration.

7. 4. Any input errors in your orders can be corrected using the input forms on the Media-CarTec GmbH website, with the help of a deletion and modification function, before the order is sent (by clicking the "Order now" button).

7. 5. The contractual provisions with details of the ordered goods and/or booked services, including these General Terms and Conditions and the cancellation policy, will be sent to you by email upon acceptance of the contract offer or notification thereof. We do not store the contractual provisions. 

7. 6. The prices for goods displayed on the Media-CarTec GmbH website are final prices including VAT.

7. 7. Payment to Media-CarTec GmbH becomes due upon acceptance of the order by Media-CarTec GmbH at the agreed time. Payment is made without deductions in advance by bank transfer to the account specified by Media-CarTec GmbH or by PayPal.

7. 8. We would like to inform you that, in addition to the ordinary legal remedies, you also have the option of out-of-court dispute resolution in accordance with Regulation (EU) No. 524/2013. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. 

 

Consequences of Withdrawal

 

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. 

You must send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
